Terms of Service

1. Acceptance of Terms

By accessing or using Bootekol ("the Service"), operated at bootekol.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. Material changes will be indicated by updating the version date above.

2. Age Requirements

The Service contains adult content. You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access or use the Service. By using the Service, you represent and warrant that you meet this age requirement.

If we become aware that a user is under the required age, their access will be terminated immediately.

3. Account and Identity

Bootekol respects your privacy and does not require you to disclose your real identity to use the Service. You may browse and use the platform without creating an account or providing personal identification, except where required by applicable law (for example, in response to a valid legal process).

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Upload, post, or transmit any content that depicts minors in any context.
• Attempt to gain unauthorized access to the Service, other users' accounts, or connected systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated tools (bots, scrapers, crawlers) to access the Service at a rate that degrades its performance for other users.
• Harass, threaten, or impersonate other users.
• Circumvent any access restrictions, rate limits, or content filtering mechanisms.

5. Content Moderation

In accordance with Regulation (EU) 2022/2065 (the Digital Services Act), Article 14(1), this section describes the restrictions we apply to content on the Service and the policies, procedures, and tools we use for content moderation.

Content Restrictions

We restrict content that violates our policies or applicable law. The categories of prohibited content are set out in Section 6 (Prohibited Content) below. Restrictions may result in content removal, reduction of content visibility, or suspension or termination of the account responsible for the content.

Moderation Process

Content moderation decisions are made on the basis of our platform policies and applicable law. We use a combination of automated detection tools and human review to identify content that may violate our policies or the law. Automated tools are used to flag potentially violating content for review; final decisions on content restrictions are made or confirmed by human reviewers. Reporting and Redress

If you believe content on the Service is illegal, you may report it through our illegal content reporting form or by emailing [email protected]. If a moderation decision affects your content or account, you have the right to challenge that decision — see Section 7 (Redress Mechanisms) below for details.

6. Prohibited Content

The following content is strictly prohibited on the Service:

• Any depiction, real or synthetic, involving minors.
• Non-consensual intimate imagery (revenge pornography).
• Content that promotes violence, terrorism, or self-harm.
• Content that violates the intellectual property rights of others, unless authorized or qualifying as fair use.
• Malware, phishing links, or other malicious content.

We reserve the right to remove any content that violates these Terms and to terminate access for users who post prohibited content.

7. Redress Mechanisms

If we restrict your content or account, you have the following rights and options. These mechanisms are provided in accordance with the Digital Services Act, Articles 17, 20, and 21.

• Statement of reasons (Art. 17). When we restrict your content or account — including content removal, visibility reduction, account suspension, or account termination — you will receive a clear statement of reasons explaining the nature of the restriction, the facts giving rise to the decision, and the legal or policy basis for it. This notice will be sent to your registered email address.
• Internal appeal (Art. 20). You may challenge any moderation decision by submitting an appeal at no cost through our appeal form. Appeals are handled by human reviewers and you will receive a motivated decision — one that explains the reasoning, not merely the outcome — within 14 calendar days of receipt.
• Out-of-court dispute settlement (Art. 21). If you have exhausted the internal appeal mechanism and remain dissatisfied, you may refer the matter to a certified out-of-court dispute settlement (ODS) body. Certified ODS bodies for the Netherlands are listed by the ACM (Autoriteit Consument & Markt) at acm.nl/en/topics/digital-services-act. We will engage with the ODS process in good faith.
• Illegal content reporting (Art. 16). Any person may report content they believe to be illegal through our illegal content reporting form or by emailing [email protected]. You do not need an account to submit a report.
• Judicial redress. None of the mechanisms described above affect your right to seek judicial redress in a court of competent jurisdiction.

8. Content Ownership and Licensing

You retain ownership of any content you upload to the Service. By uploading content, you grant Bootekol a non-exclusive, worldwide, royalty-free license to host, display, distribute, and cache your content solely for the purpose of operating and providing the Service.

This license terminates when you remove your content from the Service, except that cached or archived copies may persist for a reasonable period as part of normal operations.

Bootekol does not claim ownership over user-uploaded content.

9. Copyright Infringement (DMCA Process)

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, you may submit a takedown notice containing:

1. Identification of the copyrighted work you claim is infringed.
2. Identification of the infringing material and its location on the Service (URL or other specific reference).
3. Your contact information (name, address, email, phone number).
4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
6. Your physical or electronic signature.

Upon receipt of a valid takedown notice, we will remove or disable access to the identified material and notify the uploader. Counter-notices may be filed in accordance with the DMCA.

Repeat Infringer Policy: In accordance with the DMCA, we maintain a repeat infringer policy. Accounts that receive three or more valid DMCA takedown notices within a 12-month period will be permanently terminated and all associated content removed. A successful counter-notice will remove the corresponding strike. For full details, see our Content Removal Policy.

10. Account Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

You may delete your account at any time. Upon deletion, your uploaded content will be removed, though cached copies may persist temporarily as described in Section 8.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content on the Service is accurate or complete.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Bootekol and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service.
• Any unauthorized access to or use of our servers or any personal information stored therein.
• Any content posted, uploaded, or transmitted through the Service by any third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Delaware.
